Contractual Terms

If you sign a contract you are bound by that contract. The following link is to a commentary on the High Court case “Toll v Alphapham” which is often quoted by Solicitors and Barristers in putting an argument that the terms of a signed contract are binding on both parties.

The following is a short extract from the 6-page PDF commentary:

“When a document containing contractual terms is signed, then, in the absence of fraud, or, I will add, misrepresentation, the party signing it is bound, and it is wholly immaterial whether he has read the document or not”

Village in Receivership

“What happens if a Retirement village operator becomes Insolvent or goes onto Receivership?”

This paper was written by Les Armstrong, President of the Association of Residents of Queensland Retirement Villages (Inc) in May 2011. There have been a number of retirement village operator failures throughout Australia in recent years, and the various State Residents Associations have made a number of representations to their State Governments regarding the issues of concern for residents. Many of the representations were specific to the legislation in a particular State; however this document tries to extract some of the more general points.
